An Interresting Approach to Protecting Your IP
Apparently frustrated by the Thai government's issuance of a compulsory licenses for two of its drugs, one an AIDS medication, Abbott laboratories has indicated that it won't introduce new drugs in Thailand. While the Thai government and Abbott had been in negotiations over price, it appears those discussions reached an impass.
Abbott's move is being condemned by AIDS activists and raises some sticky PR issues. The biggest question, however, will be the result. Is Abbott simply giving up market share and giving itself a black eye, or will large patent holders be able to gain some leverage against countries who opt out of the patent system when it is beneficial to do so?
