Vonage Dodges Another Bullet
Two weeks ago, Vonage dodged a bullet when the Court of Appeals for the Federal Circuit granted a temporary stay to a district court injunction which would have barred Vonage from adding new customers. Yesterday, the Federal Circuit made the stay permanent. Thus, Vonage will be able to continue to add new customers while the appeal progresses.
As part of the stay, Vonage will pay a royalty of 5.5 percent into an escrow account. It will also post a $66 million bond. The stay will allow Vonage to argue its appeal. (The Federal Circuit overturns up to 40 percent of lower court decisions). It also buys Vonage time to try another work around.
